Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and Northsight Holdings LLC, a Wyoming limited liability company (“FedHorizon,” “we,” “us,” or “our”), governing your access to and use of fedhorizon.com and all related products, tools, reports, and services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

FedHorizon is a user-directed, educational scenario modeling and decision-support platform designed to help users explore hypothetical retirement-related outcomes under the Federal Employees Retirement System (FERS).

The Service:

  • Generates scenario-based estimates and projections
  • Relies entirely on user-provided inputs and assumptions
  • Produces hypothetical, illustrative outputs

The Service does not:

  • Provide financial, investment, tax, or legal advice
  • Make recommendations or suggest specific courses of action
  • Provide official determinations from the U.S. Office of Personnel Management (OPM) or any government agency
  • Act as a financial advisor, fiduciary, or retirement planner

All outputs are user-driven analyses, not recommendations.

AI-Assisted Narrative Generation: Some report narrative and plain-English explanations are generated using AI language models. All numerical outputs — pension calculations, supplement projections, TSP estimates, and related figures — are produced exclusively by deterministic, formula-based engines and are not generated by AI. AI is used only to explain outputs in plain English, never to calculate them.

3. Critical Disclaimer — No Advice; No Fiduciary Relationship

THE SERVICE IS PROVIDED FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

Nothing in the Service constitutes:

  • Financial or investment advice
  • Tax advice
  • Legal advice
  • Benefits counseling
  • Personalized retirement planning

FedHorizon does not make recommendations and does not tell you what you should do. The Service merely allows you to explore hypothetical scenarios based on inputs you choose.

NO ADVISOR-CLIENT, ATTORNEY-CLIENT, OR FIDUCIARY RELATIONSHIP IS CREATED.

4. No Reliance

You expressly agree:

  • Not to rely on the Service as the primary basis for any financial or retirement decision
  • That all decisions you make are solely your responsibility
  • That you will seek qualified professional advice before making material financial or retirement decisions

The Service is one informational input among many, not a decision-making authority.

5. Accuracy, Assumptions, and Limitations

All outputs are:

  • Based solely on user-provided inputs
  • Derived from generalized formulas and assumptions
  • Intended for illustrative purposes only

FedHorizon does not guarantee that:

  • Calculations reflect current OPM rules or agency-specific policies
  • Data inputs (e.g., COLA, growth rates, premiums) are accurate or up to date
  • Outputs match actual retirement benefits

Assumption Sensitivity

Outputs are highly sensitive to inputs and assumptions. Small changes in inputs may produce materially different results.

Forward-Looking Uncertainty

All projections are inherently uncertain and speculative. Actual outcomes will differ, potentially significantly.

6. Regulatory and Government Disclaimer

FedHorizon is:

  • Not affiliated with the U.S. Government or OPM
  • Not a registered investment advisor, broker-dealer, or financial planner

The Service does not provide regulated financial advice and is intended solely as a general-purpose modeling tool.

7. User Responsibilities

You must be at least 18 years of age to use the Service. By accessing the Service, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use the Service.

You agree that:

  • All information you provide is accurate to the best of your knowledge
  • You will use the Service only for lawful, personal, non-commercial purposes, except as expressly authorized under a separate commercial license agreement with FedHorizon
  • You will not misuse, reverse-engineer, scrape, or exploit the Service
  • You understand the limitations and risks of scenario-based modeling

You are solely responsible for your decisions, your interpretations of outputs, and any consequences resulting from use of the Service.

8. Payments, Subscriptions, and Refunds

Certain features require payment. All fees are in U.S. dollars. Payments are processed by third-party providers, including Stripe, Inc. By submitting payment, you authorize charges to your selected method.

Subscriptions and Billing

Where FedHorizon offers subscription-based access, the following applies:

  • Billing cycle: Subscriptions are billed on the same calendar date each month or year, beginning on the date of your initial purchase.
  • Cancellation: You may cancel your subscription at any time through your account settings or by emailing legal@fedhorizon.com. Cancellation takes effect at the end of the current billing period. You will retain access through the end of the paid period.
  • Proration: FedHorizon does not provide prorated refunds for partial billing periods unless required by applicable law.
  • Auto-renewal: Subscriptions automatically renew unless cancelled before the renewal date. We will send a reminder notice at least 7 days before renewal for annual subscriptions.

Third-Party Payment Disclaimer

FedHorizon is not responsible for payment processor errors, security breaches, transaction failures, or third-party system outages.

Refund Policy

Due to the immediate delivery of digital products, all sales are final except if you were charged and did not receive the product, or a technical failure prevented delivery and cannot be resolved within 5 business days. Refund requests must be submitted within 7 calendar days of the purchase date by emailing legal@fedhorizon.com.

9. Intellectual Property

All Service content — including software, algorithms, reports, and design — is owned by or licensed to FedHorizon and protected by law. You are granted a limited, non-transferable license for personal use only.

You may not copy, distribute, or resell outputs; reverse-engineer or replicate the Service; or use outputs commercially without permission.

10. Privacy and Data Retention

Your use of the Service is governed by our Privacy Policy, available at fedhorizon.com/privacy. The Privacy Policy describes in full how we collect, use, store, and delete your data, including applicable retention periods. By using the Service, you acknowledge and agree to the data practices described in the Privacy Policy.

In summary, the Service collects information you voluntarily provide, which may include federal pay grade, years of service, salary, retirement dates, TSP balance, and email address. This information is used solely to generate your requested outputs. It is not sold to third parties and is not used for advertising. Free estimate inputs are not stored on our servers. Report inputs are retained only as long as necessary to deliver and support your report, and are purged within 30 days of delivery unless you have an active account. 11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” FEDHORIZON DISCLAIMS ALL WARRANTIES, INCLUDING ACCURACY, RELIABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE CONTINUOUS AVAILABILITY, ERROR-FREE OPERATION, OR SECURITY.

12. Service Availability

We may modify, suspend, or discontinue the Service at any time. FedHorizon is not liable for downtime, data loss, or interruptions.

13. Force Majeure

FedHorizon shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, internet or telecommunications failures, power outages, or third-party service provider failures. In any such event, FedHorizon’s obligations will be suspended for the duration of the force majeure condition.

Note on regulatory changes: Changes to federal law, OPM rules, or FERS regulations are not treated as force majeure events. FedHorizon is responsible for updating its formula engines to reflect material regulatory changes within a reasonable time. However, FedHorizon does not guarantee real-time compliance with regulatory changes and is not liable for outputs that reflect rules superseded by subsequent government action before FedHorizon has had a reasonable opportunity to implement updates.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEDHORIZON SHALL NOT BE LIABLE FOR FINANCIAL LOSSES, LOST RETIREMENT BENEFITS, LOST SAVINGS, OR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY IS LIMITED TO THE GREATER OF THE AMOUNT PAID IN THE PRIOR 12 MONTHS OR $100.

15. Indemnification

You agree to indemnify and hold harmless FedHorizon from any claims arising from your use of the Service, your reliance on outputs, decisions made using the Service, violations of these Terms, or disputes with third parties resulting from your decisions.

16. Dispute Resolution — Arbitration

16.1 Informal Resolution

Before initiating any arbitration, contact us at legal@fedhorizon.com with a written description of your dispute, the relief sought, and your contact information. We will attempt to resolve the matter informally within 30 days.

16.2 Binding Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules. Arbitration will be conducted in Wyoming or via videoconference. By agreeing to arbitration, you waive your right to a jury trial.

JAMS Consumer Minimum Standards: For qualifying consumer disputes, JAMS Consumer Minimum Standards apply and may modify certain terms in your favor. Nothing here limits your rights under applicable consumer protection laws.

16.3 Class Action Waiver

YOU AND FEDHORIZON AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY. CLASS ARBITRATIONS, CLASS ACTIONS, AND CONSOLIDATION WITH OTHER ARBITRATIONS ARE NOT PERMITTED.

16.4 Small Claims Court

Either party may bring an individual claim in small claims court if the claim qualifies under that court’s jurisdictional limits.

16.5 Emergency Relief

Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm. Seeking such relief does not waive the right to arbitration.

17. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law principles. This governing law applies to all disputes, including those submitted to arbitration under Section 16.

18. Termination

We may suspend or terminate your access at any time for cause (including violation of these Terms) without refund. If we terminate your access without cause and you are a paid subscriber with unused subscription time remaining, we will provide a prorated refund for the unused portion of your current billing period. Termination does not affect your right to access reports already delivered and paid for. Sections 3, 4, 9, 13, 14, 15, and 16 survive termination.

19. Modifications to These Terms

We may update these Terms at any time. For material changes, we will provide at least 30 days’ advance notice via email or prominent notice on the Service. Continued use after the effective date constitutes acceptance of the revised Terms.

20. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and FedHorizon with respect to the Service.
